At the point that a work has been created, it is subject to copyright.  The work no longer has to be published or registered with the Copyright Office.

(examples for educators)

• a student writes a poem using pencil and paper
• a student draws a picture

Then the work is subject to the copyright law. 

 Teachers need to remember that their students can be copyright holders.
